Terms of Service

These Terms of Service ("Terms") govern your use of MemorialConcepts, operated by Omnyconcepts LLC ("we", "us", "our"). By creating an account or using our service, you agree to these Terms. We've written them in plain language, but they are a binding agreement.

The service

MemorialConcepts is a planning tool that helps families coordinate the budget, contributions, and logistics for memorial events. We provide an authenticated dashboard for the event owner, plus optional read-only share links for family members who don't need accounts.

We are a software service. We are not a funeral home. We are not a financial institution. We do not provide bereavement counseling. If you need those services, please seek them from qualified professionals.

Your account

You are responsible for keeping your account credentials secure. Don't share your password. Don't let other people use your account.

If you suspect unauthorized access to your account, change your password immediately and email us at support@memorialconcepts.com.

You must be at least 18 years old to create an account. If you're under 18, please ask a parent or guardian to create the account.

Pricing and payment

MemorialConcepts offers three tiers:

• Plan is free, with limited features.
• Honor is ₦25,000, paid one-time per event.
• Repose is ₦75,000, paid one-time per event.

Paid tiers grant lifetime access for the specific event you're upgrading. There is no recurring subscription. After payment, your event remains active in your dashboard indefinitely, with all the features included in your tier.

All payments are processed through Paystack. We accept the payment methods Paystack supports in your region.

Refunds

We handle refund requests on a case-by-case basis. If you've paid for a tier and are unsatisfied with the service, email support@memorialconcepts.com within 14 days of your payment with a description of the issue, and we'll respond within 3 business days.

Refunds are not guaranteed, but we are reasonable people. If we made a mistake, we'll fix it.

Acceptable use

You agree not to:

• Use the service for any illegal purpose
• Create accounts under false pretenses
• Misrepresent your identity or affiliation with the deceased
• Use the service to harass, defame, or impersonate others
• Attempt to gain unauthorized access to other users' accounts or events
• Probe, scan, or test the security of our systems without permission
• Upload malicious code or content
• Use automated tools to scrape or extract data from the service

We reserve the right to suspend or terminate accounts that violate these terms.

Your content

The information you record in MemorialConcepts (event details, budget items, contributor names, contribution amounts, share links) is your content. You own it. We don't claim any rights to it.

You grant us a limited license to store, process, and display your content as necessary to provide the service to you and to anyone you've authorized via share links.

You are responsible for the accuracy of the information you record. If a contributor disputes an amount you've recorded, that's between you and them — we don't mediate disputes about the underlying contributions.

Share links

When you create a share link, you are choosing to make a portion of your event data accessible to anyone who has the link. We provide tools to revoke share links at any time.

Anyone with a working share link can view what you've configured to be shared. We log access count and timestamps but do not require viewers to identify themselves. If you want to know specifically who viewed the event, send the link to specific people and trust them not to forward it.

We are not responsible for what people do with information they obtain via share links. Revoke any link you suspect has been shared beyond your intent.

Service availability

We work hard to keep MemorialConcepts available, but we cannot guarantee 100% uptime. We may need to perform maintenance, deploy updates, or respond to security incidents that temporarily affect availability.

We will not be liable for any losses caused by service unavailability, including but not limited to delayed memorial planning, missed contributions, or scheduling conflicts.

Limitation of liability

To the maximum extent permitted by law, our liability to you for any claim arising from your use of MemorialConcepts is limited to the amount you've paid us in the 12 months preceding the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we've been advised of the possibility of such damages.

Termination

You may stop using MemorialConcepts at any time. To delete your account and data, email support@memorialconcepts.com.

We may suspend or terminate your access if you violate these Terms, or if we're required to do so by law. We'll give you reasonable notice when possible.

Termination does not entitle you to a refund of fees already paid, except as described in the Refunds section above.

Changes to these terms

We may update these Terms as our service evolves. When we make material changes, we'll update the "Last updated" date at the top, and notify active users by email.

Continued use of the service after changes take effect constitutes acceptance of the updated Terms. If you don't agree to the changes, stop using the service and request account deletion.

Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of MemorialConcepts will be resolved in the courts of Nigeria, unless local law in your jurisdiction grants you alternate rights.
